Have you noticed the decorations in shops already? Yes, it is that time of the year that gets frantic with commitments in the lead up to the Christmas holiday period. The Federal Circuit and Family Court of Australia (FCFCOA) is no different.

 

Unfortunately, Christmas has always been a time that can be difficult for separating families, particularly when there are no orders or even informal arrangements in place. Parties often cannot find agreement on how they will share Christmas and New Year festivities, particularly when there are family traditions and significant time with other members of family, often with travel involved. How children should spend significant time with their family differs – so how can co-parenting couples come to agreement and be fair?

 

This adds particular strain on the Court system at this time of year, with so many parties applications being lodged, so there is actually a specific ruling to deal with the influx, in the form of a deadline for when applications need to be filed, so that the issue of time can be determined before the Court closes for the year.

 

This year the deadline is 4pm on 11 November 2022, unless there is an exception made relating to urgency, but the criteria for urgency is at the Court’s discretion so you cannot depend on that.

  

Every year our firm unfortunately needs to deal with legal negotiations, mediation and Court proceedings that could have been dealt with more efficiently and with less stress if only clients came to us earlier, when they could see that coming to agreement and documenting that either formally or informally might be an issue.
