The Family Law Act 1975, provides that a de-facto relationship exists where you and a partner or former partner have had a genuine domestic relationship.
There are a number of factors which point to whether you were in fact living on a genuine domestic basis some of these include whether you lived together, shared finances or financially supported one another, presented to your community as a couple, have children together among other matters.
You have two years from the date of separation to seek the assistance of the Court to finalise your property settlement.
